Dear Readers,

On the last day before its summer break, the Bundesrat [upper house of German parliament] approved an “investment booster”. Consequently, for the Key Issue report in the summer edition of our PKF Magazine we have put together a summary of the tax breaks for businesses that aim to incentivise more investment. The second report in the Tax section considers the key aspects of a second draft circular from the fiscal administration on the new updates in relation to e-invoicing. Apart from the clarification with respect to the obligation to receive e-invoices and the exemption for small businesses, the circular contains many explanations regarding the technical and content-related requirements for input tax deduction. The report that follows is about an important change to the legislation on the conversion of companies according to which one of the structures that has been popular in practice will now no longer be automatically possible. As it is only a question of time before the registration courts likewise become aware of this provision there is a need for alternative structures. Subsequently, we consider an issue taken from a recent ruling, namely, whether or not it is possible for both gift tax and income tax to be triggered concurrently in a single case.

The first report in the Legal section is about a legislative amendment on the basis of which women will also be able avail to themselves of paid maternity leave in the case of a miscarriage. The second report presents the new rules for the integration subsidy that have been in force since January 2025. Here, employers can find out how they can generate considerable financial benefits through this funding.

As always, short reports likewise round off this edition of our magazine. The particular focus here is on training obligations when using artificial intelligence, effectiveness when delivering notices of termination and changes in the area of value-added tax.
