Dear Readers,

The Federal Government is pouring out its cornucopia and, in doing so, its intention is to provide relief to all taxpayers. Our Key Issue report, in the Tax section, will give you an overview of the relief and changes that will be ushered in by the 2025 Tax Amendment Act. The focus then switches to a dispute over the inheritance of a trade tax credit. The third report deals with the civil law and inheritance tax consequences when a community of accrued gains is terminated by death. Following the start to our series in October, in this issue we highlight avoidance strategies during lifetimes in order to reduce the tax burden in cases of high wealth disparities. 

In our Accounting and Finance section, we categorise sale-and-lease-back and asset-based credits as tools for financing transformation tasks at small and medium-sized enterprises.

The aforementioned government cornucopia will also benefit pensioners. In the first report in our Legal section, we consider the Active Pension Act and describe how, as a consequence, pensioners are supposed to bolster the job market at very interesting conditions. In the report that then follows, we once again discuss the expiry of annual leave entitlement - the topic here is how to deal with a payment claim in lieu after the termination of an employment relationship.

For our short reports section, we dipped into the cornucopia of rulings to put together, once again, articles on serious and, in some cases, also curious issues. Here, these include a signed handover report at the end of a rental period, the classification for tax purposes of the salary of a managing director at a GmbH [German limited liability company] following the sale of their shares, and a further question, namely, whether or not the remuneration of a managing director at a partnership even constitutes a salary.
