This October issue is the first in our new online format of the PKF magazine. With regard to this, you might like to read the quote about the change from the present and the stuff of memory. However, collectively we want to continue to provide you, once a month, with content that differentiates us - hopefully in the best possible sense - from our competitors.

After having procrastinated for two years, quite recently the fiscal administration, in a current Federal Ministry of Finance circular, fortunately adopted the Federal Fiscal Court ruling on incongruent profit distributions at corporations. This was reason enough for us to present the new regulations in our first report in the Tax section. The report that follows deals with the issue of whether the expenses in the context of a company party are deductible for tax purposes or whether they are very much of a private nature.
The first report in the Accounting & Finance section is also Our Key Issue report where we discuss the new Section 289(3a) of the German Commercial Code that has been added to the rules for the management report in the context of the CSRD. Here, the disclosure obligations with respect to intangible resources go far beyond sustainability aspects and will affect most large companies. Subsequently, we discuss the so-called platform economy. Everyone is aware of platforms such as, for example, Check24. However, prior to using large platforms as a distribution channel, companies should consider whether there are alternatives to these where you can communicate the switch-over more efficiently with customers.
The so-called German Accessibility Strengthening Act is a major step towards a more inclusive society. We have summarised the changes that will admittedly only be applicable from next year, nevertheless processes with regard to many products and services will need to be adapted now already. Our second report in the Legal section is about companies in crisis situations. We have compiled the options available to majority shareholders in corporations when minority shareholders do not want to participate in a restructuring.
